Terms of Service

1. About FarmBizAfrica

FarmBizAfrica ("we", "us", "the Platform") is a digital agriculture hub serving smallholder farmers in Kenya and the wider African region. The Platform combines independent farming tools (crop diagnosis, weather, market prices, farm mapping, satellite NDVI, field records) with a marketplace that connects farmers to vetted third-party partners offering agronomy inputs, tractor & spraying services, livestock vaccines, soil testing, insurance, financing and produce off-take.

2. Service scope & partner fulfilment

FarmBizAfrica is a technology platform. Where a service is delivered (e.g. ploughing, vaccination, soil-lab analysis, insurance underwriting, credit), the actual service is fulfilled by an independent licensed Partner that has been onboarded and approved on the Platform. The Partner — not FarmBizAfrica — is the legal provider of that service. We facilitate matching, communication, payment and dispute resolution.

3. Eligibility & account

You must be at least 18 years old (or the age of majority in your jurisdiction) and provide accurate information when you create an account. You are responsible for keeping your password confidential and for all activity on your account.

4. Wallet, payments & escrow

The FarmBizAfrica wallet allows you to top up via M-PESA (through our payments processor IntaSend / Daraja) and pay for inputs and services in-app. When you book a service that requires partner fulfilment (e.g. a tractor request), the payment is held in escrow and is released to the Partner only when the service is marked completed by both parties. If the Partner cancels or fails to deliver within the agreed window, the held funds are returned to your wallet automatically. Wallet funds are non-interest-bearing and are not a deposit account.

5. Disputes

If a service or order is not delivered as agreed, raise a dispute from the request page within 7 days of the scheduled completion date. Our admin team will review evidence from both sides and can refund the escrow hold to your wallet, release it to the partner, or split it.

6. Free tools, no warranty

Crop diagnosis, NDVI imagery, weather forecasts, KAMIS prices, news content and crop guides are provided "as is" for informational use and do not constitute professional agronomic, veterinary, financial or legal advice. Always verify critical decisions with a qualified extension officer or agronomist.

7. Acceptable use

You may not use the Platform to commit fraud, impersonate other users, spam other farmers, circumvent escrow by transacting off-platform, scrape data at scale, or upload illegal, harmful or misleading content (including fake produce listings or fake disease scans).

8. Termination

We may suspend or close accounts that breach these Terms. You can delete your account at any time from your Profile page, which will permanently remove your personal data subject to legal record-keeping obligations (e.g. transaction records required by Kenyan tax law).

9. Liability

To the maximum extent permitted by law, FarmBizAfrica's total liability arising from your use of the Platform is limited to the fees we have collected from you in the 12 months preceding the claim. We are not liable for indirect or consequential losses, including crop loss, weather-related damage, or loss of expected profit.

10. Governing law

These Terms are governed by the laws of the Republic of Kenya. Disputes will first be referred to good-faith mediation; if unresolved, to the competent courts of Nairobi.
